Paradiseshopafrica is an online marketplace operated by Paradise Broking and Marketing Pty Ltd, reg no. 2021 / 327495 / 07, with registered address 17 River Road, Bedfordview, Germiston 2008, Johannesburg, South Africa.
Paradiseshopafrica is a platform only. We facilitate transactions between Customers and third-party Merchants. We do not take ownership of goods and are not the seller unless expressly stated. The contract of sale is between you and the Merchant.

2. Placing Orders & Pricing
1. All prices are in USD and include VAT unless stated. International customers may incur duties/taxes on import.
2. An order is only confirmed once payment is received and you get an order confirmation email.
3. We reserve the right to cancel orders due to stock errors, pricing mistakes, or suspected fraud.
3. Payments
We use [PayFast/Yoco/PayGate/Stripe] for secure payments. We do not store card details. For international cards, payments will be processed in USD and your bank may apply conversion fees.
4. Shipping & Delivery
1. Delivery times and costs are set by each Merchant and shown at checkout.
2. Risk passes to you once the courier scans the parcel as delivered. For lost/damaged goods, contact the Merchant within 48 hours.
3. Orders are fulfilled and shipped directly from the Merchant’s location within Africa. International shipping may be subject to customs clearance and delays beyond our control.
5. Returns, Refunds & Cancellations
1. Under CPA Section 20, you may return goods within 10 business days if they are faulty, unsafe, or not as described.
2. For change-of-mind returns, Merchant policy applies. This must be clearly stated on the product page.
3. Digital products and custom-made items are non-refundable unless faulty.
4. Refunds are processed back to the original payment method within 7-14 business days.
6. Merchant Responsibilities
Each Merchant warrants that:
1. They own the rights to sell the products listed.
2. Products comply with applicable safety and labelling standards in their country.
3. They will fulfill orders within the stated timeframe or notify customers of delays.
7. Intellectual Property
All content on this site — logos, text, images — belongs to Paradiseshopafrica or is licensed to us. You may not copy or reproduce it without permission.
8. User Conduct
You agree not to use the site for fraud, spamming, or posting offensive content. We may suspend accounts that breach these terms.
9. Limitation of Liability & Indemnity
9.1 Limitation of Liability: To the fullest extent permitted by SA law, Paradiseshopafrica is not liable for indirect loss, loss of profit, or damages arising from use of the platform. Our liability is limited to the amount you paid for the order.
9.2 Indemnity: You agree to indemnify and hold harmless Paradiseshopafrica, its affiliates, officers, and employees against any claims, losses, and expenses arising from your use or misuse of the website and mobile application.

11. Disputes, Governing Law & Resolution
1. Governing Law: These Terms and all transactions on the platform are governed by the laws of the Republic of South Africa.
2. Internal Resolution: Before starting any legal process, you agree to contact the Merchant and Paradiseshopafrica to attempt to resolve the dispute in good faith. We will provide free mediation between you, Paradiseshopafrica, and the Merchant.
3. Arbitration: If the dispute is not resolved within 30 days of first notice, it will be referred to arbitration in Johannesburg, South Africa, under the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration will be conducted in English by a single arbitrator.
4. Arbitration Award: The arbitrator’s decision is final and binding. Awards are enforceable in any court with jurisdiction.
5. Consumer Rights: Nothing in this clause limits or excludes any rights you may have under the Consumer Protection Act 68 of 2008, or equivalent consumer protection law in your country.

13. International Trade & Regional Agreements
Applies to all orders shipped outside the Merchant’s country.
13.1 COMESA & AfCFTA Coverage
Paradiseshopafrica ships to COMESA member states and all African Union member states participating in the African Continental Free Trade Area (AfCFTA).
1. For eligible goods shipped between COMESA/AfCFTA member states, preferential tariff rates may apply where the product meets the agreement’s Rules of Origin.
2. It is the Customer’s responsibility to provide any required documentation for preferential treatment, including a valid Certificate of Origin where requested.
3. We do not guarantee duty-free entry. Final duty and tax assessment is made by the destination country’s customs authority.
13.2 Duties, Taxes & Import Fees
1. All international orders may be subject to import duties, VAT, customs clearance fees, and taxes imposed by the destination country.
2. These charges are levied by the customs authority and are the responsibility of the Customer/Recipient. Paradiseshopafrica and the Merchant have no control over these charges.
3. DDP – Delivered Duty Paid: Duties and taxes are calculated and prepaid at checkout. No further charges on delivery.
4. DDU – Delivered Duty Unpaid: Duties and taxes will be billed to you by the courier or customs on delivery. The shipping option selected at checkout will show whether DDP or DDU applies.
13.3 Prohibited & Restricted Goods
Each African country and other destination countries have import restrictions. It is your responsibility to ensure the product can be legally imported. We will not refund orders seized, destroyed, or returned due to import restrictions.
13.4 Delivery Timelines for International Orders
Cross-border shipments between African countries via COMESA/AfCFTA routes may still experience delays due to customs inspections, holidays, and logistics outside our control. Estimated timelines shown at checkout are not guaranteed.
13.5 Currency & Payments
All prices are displayed in USD. For non-South African customers, your bank or payment provider may convert to your local currency at their exchange rate. We are not responsible for conversion fees.
